NouriLoop Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and John C. Houser (“NouriLoop,” “we,” “us”) governing your use of the NouriLoop application and website at nouriloop.com (the “Service”). By creating an account or using the Service, you agree to these Terms and to our SMS Privacy Policy and Consumer Health Data Notice. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service and have the authority to accept these Terms. The Service is not directed to children under 13, and we do not knowingly collect their information.
2. The Service
NouriLoop is a personal wellness tool that lets you log meals (including photo-based analysis), track daily nutrition and trends, import health metrics, record symptoms, set nutrition goals, and receive reminders. It is provided for general informational and educational purposes only.
3. Not medical advice
NouriLoop does not provide medical, nutritional, or health-care advice, diagnosis, or treatment, and is not a substitute for a qualified professional. Nutrition figures, inflammation and goal scores, and suggestions are estimates and educational signals only. Always consult a physician or qualified provider before making decisions about your diet or health, and never disregard or delay professional advice because of something in the Service. NouriLoop is not a HIPAA-covered entity.
4. AI-generated estimates
Food-photo analysis, nutrition values, and goal narratives are generated in part by automated and AI systems (including third-party AI providers) and may be inaccurate or incomplete. You are responsible for reviewing and correcting estimates before relying on them, and the Service gives you tools to do so.
5. Accounts and access
Registration is open to the public and free to start; an optional coupon may grant additional features. You agree to provide accurate information, to keep your password secure, and to be responsible for activity under your account. Notify us promptly of any unauthorized use. We may suspend or disable accounts that violate these Terms.
6. Acceptable use
You agree not to misuse the Service, including: accessing other users’ data; attempting to breach security or disrupt the Service; uploading unlawful, infringing, or malicious content; scraping or overloading the Service; or using it to provide services to third parties without our permission.
7. Your content
You retain ownership of the photos and data you submit (“Your Content”). You grant us a limited license to store and process Your Content solely to operate and provide the Service to you (for example, sending a meal photo to our AI provider to estimate nutrition). You represent that you have the right to submit Your Content.
8. SMS text-message program
If you opt in, NouriLoop sends recurring automated account/transactional SMS notifications about your own data (no marketing). By providing your mobile number and agreeing to the consent statement on the Settings → Notifications page, you consent to receive these texts at that number.
- Message frequency varies with your activity and settings — typically up to about one message per day.
- Message and data rates may apply per your mobile carrier and plan. NouriLoop does not charge for SMS.
- Reply STOP to cancel at any time, or HELP for help; you may also turn SMS off in Settings.
- Carriers are not liable for delayed or undelivered messages.
- Consent to SMS is not a condition of using NouriLoop (email delivery is always available). How we handle SMS data is described in our SMS Privacy Policy; mobile opt-in data and phone numbers are not shared with third parties or affiliates for marketing.
9. Third-party services
The Service relies on third-party providers, including Anthropic (AI analysis), Twilio (SMS), and email delivery. Their handling of data is governed by their own terms and policies.
Analytics and cookies
On our public website we use Google Analytics 4 to understand how visitors find and use NouriLoop, so we can improve it. Analytics cookies are off by default and are only set if you choose “Accept” on our cookie banner; you can decline with no loss of functionality. We send Google only standard page views and a small set of named events (for example, creating an account or starting a subscription). We never send your health data, meals, metrics, or any personal content to analytics. The cookie that records your choice is a first-party cookie and contains only that preference.
If you arrive from one of our ads, the link carries campaign labels in its web address (for example which ad campaign it belongs to). We keep those labels in your browser session and, if you go on to create an account, save them with your account so we can tell how many people each campaign brought us. We use them only as counts by campaign — never to build a profile of you, and they are never shared with anyone. This is entirely first-party: no third party is involved, and it does not depend on the analytics cookies described above.
We also use the Meta Pixel (Facebook/Instagram) on our public, logged-out pages only — it is never loaded on any page that displays your health information, including your meals, health metrics, symptoms, trends, or insights. The one exception is the order-confirmation page shown right after you start a subscription, where it records only that single conversion. It is subject to the same opt-in cookie consent described above, and we send it only page views on public pages and the same named account/subscription events, never health data.
10. Intellectual property
The Service, excluding Your Content, is owned by NouriLoop and protected by applicable laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial wellness tracking.
11. Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that estimates will be accurate.
12. Limitation of liability
To the fullest extent permitted by law, NouriLoop will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of (or inability to use) the Service. Our total liability for any claim relating to the Service will not exceed USD $100.
13. Indemnification
You agree to indemnify and hold NouriLoop harmless from claims and expenses arising out of Your Content, your use of the Service, or your violation of these Terms.
14. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access for any violation of these Terms or to comply with the law. Sections that by their nature should survive termination will survive.
15. Changes to these Terms
We may update these Terms and will revise the “Last updated” date above. Material changes will be communicated through the Service before they take effect; continued use after changes means you accept them.
16. Subscription and billing
NouriLoop offers a free tier plus two paid subscription tiers, billed through our payment processor, Stripe:
- Free — core logging with a monthly limit on photo analyses.
- Loop — $5/month or $48/year.
- Loop+ — $9/month or $79/year.
Auto-renewal. Paid subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current price for your plan, using your saved payment method, until you cancel.
Free trial. New subscribers receive a 7-day free trial, which requires a valid payment method and grants full access to the subscribed tier during the trial. If you do not cancel before the trial ends, your payment method is charged and the subscription begins. Cancelling before the trial ends incurs no charge.
Cancellation. You may cancel at any time via Account Settings (which opens our payment processor's billing portal). Your access continues through the end of the period you have already paid for, and then your account returns to the Free tier.
Refunds. Payments are non-refundable for partial billing periods. Annual subscribers may request a full refund within 30 days of the initial annual purchase by contacting us at the address below.
Price changes. We may change subscription prices. For active subscriptions, we will provide at least 30 days' notice before a price change takes effect, and the new price applies on your next renewal.
17. Binding arbitration and dispute resolution
Please read this section carefully. It affects your legal rights.
You and NouriLoop agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service (a "Dispute") will be resolved exclusively by binding individual arbitration, not in court, except as set out below. You and NouriLoop each waive the right to a jury trial and the right to participate in any class action, class arbitration, or representative proceeding.
Informal resolution first. Before initiating arbitration, the party raising the Dispute must give the other party written notice describing the Dispute in reasonable detail and a 30-day opportunity to resolve it informally.
Arbitration rules. If the Dispute is not resolved informally, it will be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, or — if AAA is unavailable — JAMS under its Streamlined Arbitration Rules. The arbitration will be conducted in English. The arbitrator's award will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Small claims exception. Either party may bring an individual claim in small claims court if the claim qualifies and remains in that court.
Costs. Filing fees and arbitrator compensation are governed by the applicable AAA or JAMS rules. NouriLoop will not seek attorneys' fees against you unless the arbitrator finds your claim frivolous.
Severability. If the class-action waiver is found unenforceable for a particular claim, that claim must proceed in court and all other claims must proceed in arbitration.
18. Governing law
These Terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-laws rules. To the extent any Dispute is not subject to arbitration under Section 17, the courts located in Oregon will have exclusive jurisdiction.
